Equity Perps Get a Green Light on US Exchanges

Latest crypto news from Washington centers on CFTC perpetual futures tied to individual stocks. On November 3, 2026, Chairman Michael Selig said these equity perps can start trading on CFTC-registered exchanges for the first time.

Perps track a price that never expires and use periodic funding payments to stay near the spot price.

CFTC Official Release

Selig’s official statement says the contracts were deemed approved under Commission Regulation 40.3 as security futures products. That places them under the Commodity Exchange Act, federal securities laws, and the rules of both agencies. It names no exchanges, stocks, or launch dates.

Selig described the move as a way to bring perps onshore, so US traders can use them under a regulated framework instead of offshore venues. He linked it to the May 2026 approval of a Bitcoin perpetual contract and a March 2026 memorandum of understanding between the two agencies.

Capital Markets Alliance Sues Over Single-Stock Perps

The Capital Markets Alliance (CMA) filed suit the same day in the Southern District of New York. The group includes Cboe, Citadel Securities, and the Healthy Markets Association. The complaint lists the case as 1:26-cv-09608.

The complaint argues that:

  • The contracts are security-based swaps, which fall under SEC jurisdiction.

  • The approval broke the Administrative Procedure Act by giving no adequate explanation.

  • The agency did not address its earlier treatment of perpetual derivatives as swaps or weigh investor impacts.

The contracts are security-based swaps, which fall under SEC jurisdiction.

The approval broke the Administrative Procedure Act by giving no adequate explanation.

The agency did not address its earlier treatment of perpetual derivatives as swaps or weigh investor impacts.

These points are allegations in the complaint, not court findings. The group seeks to vacate the approvals, a ruling that they are security-based swaps, and an injunction while the case continues.

Why Cboe Says Investor Protection Is at Stake Now

Cboe issued its own statement backing the suit. CEO Craig Donohue said the agency’s actions threaten to erode a framework that has protected investors for more than nine decades. It says it joined alongside some of the largest US market participants and investor advocates.

Cboe says securities products belong on registered securities platforms. It also says the approvals create regulatory arbitrage and undermine market integrity. Donohue said the case is not commercial, since Cboe could list such products on CFTC-regulated platforms it operates.

Two Legal Views on the Same Contracts Compared

The CFTC perpetual futures dispute comes down to classification. The Capital Markets Alliance calls the contracts swaps, while the regulator treats them as products under the joint framework.

A ruling could decide whether US stock-linked perps sit under one agency or two. That affects which exchanges can list them and which safeguards apply.

What the CFTC Perpetual Futures Fight Means Next

No ruling on the injunction request had been reported as of this news update. Kalshi, whose Bitcoin contract was approved first, also faces a separate Utah legal fight. Until a court rules, exchange plans and contract terms may change.

Other firms are also moving toward US derivatives access. ICE’s Hyperliquid-based plan shows the same push to bring perps into regulated markets.

The Lighter license news covers another crypto derivatives platform moving toward US regulatory status.
