Creating crypto-assets is now often quick and straightforward, taking only a matter of minutes. However, anyone wishing to offer a crypto asset to the public must comply with the legal requirements set out in MiCAR. The Netherlands Authority for the Financial Markets (AFM) is therefore reminding individuals who create and offer crypto-assets to the public, including memecoins, of their obligations. The AFM also urges consumers to remain alert to misleading claims and unrealistic promises.
In short
- Creating crypto-assets is easier than ever, but remains subject to legal requirements
- Obligations relating to the offeror, the white paper, and fair, clear and non-misleading information disclosure
- Consumers should remain critical and alert to misleading claims
- The AFM may take enforcement action where requirements are not met
