The cryptocurrency market is advancing as U.S. regulatory guidance and adoption by major financial institutions proceed in tandem. Staff from the U.S. Securities and Exchange Commission’s (SEC) Corporate Finance Division indicated that, based on the facts presented, Canton Coin—the native asset of the Canton Network—should be viewed as a “digital commodity.” They further stated that they would not recommend enforcement action against participants in the network who issue the coin in accordance with its programmed mechanisms, even if the coin is not registered as a security. This determination is not a broad, blanket exemption applicable to all cryptocurrencies. The SEC staff themselves emphasized that their position relies specifically on the facts provided and could change under different circumstances. Nevertheless, from a market structure perspective, it is significant. The Canton Network is known as a blockchain infrastructure designed for financial institutions, intended for transferring and managing existing financial assets such as stocks and bonds. By clearly indicating that tokens used on this network may be viewed more as commodities than securities, the SEC staff have helped reduce some of the regulatory uncertainty financial institutions face when adopting blockchain as a foundational business platform. In a related development, Morgan Stanley was reported to have become one of the first major banks to participate in tokenizing U.S. equities and Treasuries using DTCC’s tokenization service. DTCC, the central clearinghouse for the U.S. securities market, issues tokens on a blockchain backed by securities held in its DTC system. These tokens preserve the underlying rights and investor protections of the original securities and are exchangeable with their traditional counterparts—demonstrating that traditional financial assets outside the cryptocurrency market are now beginning to connect with on-chain processing. However, regulatory headwinds remain. Block disclosed that it has reached a preliminary agreement to pay approximately $764 million in connection with a U.S. Department of Justice investigation into its anti-money laundering practices. Under the proposed agreement, Block would avoid criminal prosecution for failing to maintain an effective compliance program under the Bank Secrecy Act, in exchange for a three-year deferred prosecution arrangement. Block has already set aside funds for this amount. Additionally, its Bitcoin-related gross profit fell to $52 million in the third quarter, down from $104 million in the same period last year—primarily due to reduced Bitcoin transaction fees on its Cash App platform. On the price front, uncertainty surrounding the U.S. midterm elections initially subsided; Bitcoin briefly dropped below $76,000 before rebounding to the $78,000 range. While a strengthened Democratic presence in Congress could hinder progress on crypto-friendly legislation, clearer election outcomes have triggered short-term buying pressure. The current focus has shifted to whether outflows from Bitcoin ETFs will stabilize, and whether the SEC’s individual determinations and DTCC’s implementations will evolve beyond isolated developments into a broader institutional framework. The next phase of market evaluation will likely hinge not only on price recovery but also on whether regulatory clarity, settlement infrastructure, and compliance efforts advance in tandem.
