Preliminary Democratic victories in several U.S. midterm races put the future of crypto market legislation in focus, while control of the House and Senate remained unresolved Wednesday, Nov. 4.

Former North Carolina Gov. Roy Cooper won a Republican-held Senate seat. Sen. Jon Ossoff won re-election in Georgia, and Democratic candidate Chris Pappas won in New Hampshire.

The previous Republican-led Congress passed the GENIUS stablecoin law and advanced the CLARITY Act, which would establish a broader framework for digital asset markets. A September Senate vote on the bill was 50-49, below the 60 votes required for it to move forward.

Democratic control of either chamber could change committee leadership and legislative priorities, bringing more attention to industry conflicts of interest, exchange oversight and financial risks. That shift could delay efforts to establish clearer rules for digital asset markets.

Some Democrats took part in negotiations over the CLARITY Act, but the next Congress’s plans for market-structure legislation remain uncertain. Final seat counts, committee assignments and the bill’s prospects for bipartisan support are issues to watch.
