The industry spent heavily to put friendly lawmakers in power and got a Congress run by its critics. If you hold tokens tied to the Trump family, or stocks that hold crypto, the political risk is now a line in your portfolio.

The crypto industry is bracing for a reckoning after Democrats won the US midterms and vowed to investigate the Trump family and its ties to the sector, the Financial Times reported, as summarised by Techmeme on November 8. Other outlets say Democrats are set to control both chambers after the November 3 vote, with investigations expected to soak up much of the industry's lobbying effort in the new Congress.

The people who would run those probes are already named. Maxine Waters, the California Democrat who has long attacked Trump's crypto dealings, is the leading contender to chair the House Financial Services Committee, according to MLQ.ai. Elizabeth Warren is favoured to chair the Senate Banking Committee, and Crypto.news adds that Robert Garcia is expected to lead House Oversight.

World Liberty Financial sits at the top of the list. House Financial Services Democrats have separately targeted it, its USD1 stablecoin and the TRUMP memecoin, according to PaymentExpert. Crypto.news reports that Warren and Adam Schiff signed a Senate inquiry letter, and that Warren asked in September whether gaps in anti-money laundering enforcement let Trump-linked ventures profit from illicit activity. Scrutiny is also expected to reach a reported $500 million investment by an Abu Dhabi-linked vehicle in World Liberty around the time of Trump's inauguration, plus the October 2025 pardon of Binance founder Changpeng Zhao.

Then there's Trump Media. Cryptonews, citing Arkham data, reported that wallets linked to the company moved 4,259 BTC, worth about $343 million, to Crypto.com. Nobody has shown the coins were sold, and Trump Media has not publicly explained the move. It will still read as a gift to investigators.

Senate Democrats are blocking the CLARITY Act over Trump's $2.3 billion in personal crypto profits, with Polymarket odds sitting near 43% and the August recess deadline looming. The bill needs seven Democratic crossover votes it doesn't yet have, and the White House's claimed ethics deal hasn't satisfied the lawmakers whose support it needs most. - Trump's crypto earnings blocking CLARITY Act - CLARITY Act Senate vote counting problem

Oversight hearings, document requests and possible subpoenas aimed at World Liberty, related stablecoins and the agencies that regulate them are widely expected once the new Congress convenes in January, PaymentExpert reported. Hearings are cheap to call and expensive to sit through, and every executive dragged into one will have to explain a Trump connection on camera.

What happens to the crypto bills?

Mostly, they stall. The Republican-written Clarity Act, a market structure bill, died in September when a Senate procedural vote failed 49 to 50, after Democrats demanded stricter limits on presidential crypto holdings, including forced divestment above a set value. MLQ.ai says analysts expect it to stay blocked through 2028. French Hill, its House sponsor, won reelection but loses his committee gavel, and Bryan Steil, who chaired the digital assets subcommittee, lost his seat.

Waters has a different plan. MLQ.ai reports House Democrats are weighing a market structure bill built on her 2025 Crypto Investor and Consumer Bill of Rights, with a bigger role for the SEC, a smaller one for the CFTC, and ethics provisions restricting crypto activity by Trump and other federal officials. She reportedly wants to write it directly instead of holding hearings first. Sherrod Brown, a crypto sceptic, also won reelection despite crypto PACs spending more than $63 million against him, Crypto.news noted.

That is a bad return. CNBC reported the industry spent more than $200 million on the midterms, hoping to elect leaders who could get a market structure law over the line. Frankly, the industry bought a big bet on one family and one party, and it's the family that now has to answer.

Where the market is already hurting

The selling started before any subpoena. Cryptonews.net reported the TRUMP memecoin fell more than 15% as the midterm result sank in.

The pattern is easy to read. Tokens with the clearest Trump link, like the memecoin and anything tied to World Liberty, carry the most headline risk. Exchanges and treasury companies that took Trump-adjacent flows, Crypto.com included, are the next most exposed, since a document request costs them time and legal fees even if they've done nothing wrong. Projects with no political link will mostly trade on broader risk appetite.

None of the committees has yet announced a hearing date or issued a subpoena. The new Congress doesn't convene until January, so for now the reckoning is a forecast, and the market is pricing it in early.
